Today was the second day in the Evidentiary Hearing in U.S. District Court before the Honorable John Coughenour.  The purpose of today’s testimony was for the defense to show that the attorney’s that represented Frank Atwood during his trial, sentencing and initial appellate phases of this case were all ineffective. The defense has a very difficult job in proving all his counsel was ineffective, as Mr. Bloom and Mrs. Ryan are both extremely respected attorney’s in their field, 1984 to the initial appellate phase of this case and now, these two attorney’s are regarding the best of the best. Both continue to practice law, with impeccable reputations.

The defense called Carla Ryan, counsel to Frank Atwood in the initial appellate phase; John Davis, the Prosecuting Attorney who successfully convicted Atwood of kidnapping and murder of Vicki Lynne in March of 1987; Frank Atwood, the defendant; Debbie Gaynes, Paralegal to Stanton Bloom who was Frank Atwood’s privately retained trial attorney; and finally Stanton Bloom via pre-recorded video deposition. Mr. Bloom was Frank Atwood’s private attorney who represented him from approximately August of 1985 through the sentencing phase of the case.  He is presently out of town with a prior engagement and was unable to attend the proceedings.

What I found most interesting about today’s testimony was that Frank Atwood’s team of attorney’s are attempting  to destroy the reputation of the people who represented Frank Atwood 29 years ago in effort to save him from the death penalty today. Again, there is NO disputing Frank Atwood’s guilt in this case. It has been proven and upheld.  (Please note, that Frank Atwood still maintains his innocence in this crime, however, there is a documented confession from him that was inadmissible in court in 1987. Since we are only focusing on his counsel’s lack of representation and his very disturbing criminal & mental history those are things that are not be discussed right now.)

Frank Atwood took the stand to maintain that he never refused any medical evaluation and that his attorney, Stanton Bloom, did not order any. He also testified to the fact that he wrote Judge Hawkins (presiding judge at the trail and sentencing phase, now deceased) a letter prior to his sentencing but he did not request that the judge seek a medical evaluation or take a further  look into his disturbing past. I realize that that was not necessarily Atwood’s responsibility as a defendant, but everyone was well aware of the fact that he was facing the death penalty, and quite frankly, if he felt that his attorney was not doing an adequate job to save him from the “chair” (method of execution in 1987) one would think he would have exercised his right to disclose that to the judge prior to the sentencing. Only because now it could save him from being executed is he concerned about it.

When Mrs. Gaynes took the stand, she could not remember anything. Pathetic, honestly. She is willing to participate with the defense that Mr. Bloom did not do an effective job, to save a child killing monster based on her defeat in losing the case. She testified to the fact that she saw the conviction as an ‘injustice’… honestly, I about threw up in my mouth.

I was 11 years old when my sister was kidnapped, raped and murdered by a habitual pedophile who is still seen as unfit to live among us even though he has been incarcerated for 29 years. What I remember most vividly as a young girl, was how infuriating Mr. Bloom made me.  I recognize, that as I listened to the people around us talk about the trial preparations one things rings clear in my mind and that was how extremely effective, efficient and thorough he was. Mr. Bloom did everything he could, had access to and beyond, in his representation of Frank Atwood from 1985-1987. That is without a doubt!!!!!

I have tried, on numerous attempts, to make eye contact with Frank Atwood, especially as he sat directly in front of me on the witness stand. He refused only looking to the ground or towards his attorney’s. He is a coward. A child raping,  murdering coward.

We will go back to court tomorrow am to hear the closing arguments in this hearing. They will take place at 10:00am.

When we left this mornings session, my husband and I were walking outside the courthouse when I saw a penny on the ground in front of me. When I picked it up I looked to see it was dated 1976… the year Vicki was born. Thank you Vicki… I needed that gift today!

Keeping Tucson clean one mile at a time!

It’s time for the quarterly cleanup of SR-77, mile 89-90, “Don’t Forget Vicki Lynne” 2/2/76 – 9/17/84 .

Our family has joined with two others to keep three miles of highway clean in north Tucson in memory of our loved ones. We break into groups, if you show up to do Vicki’s mile, you will actually be cleaning up her mile.

The date has been set for 8:00 am on Sunday, September 29th, 2013

My sister, Carie, has taken over the primary responsibility for the mile in honor of Vicki as our parents are now here in Montana. With the help of our brother Brian, they can use a few volunteers to clean the mile.

We ask that if you can attend that you meet at Anthony & Crystal Cillittos house at 8:00 am. You can shuttle over to the mile sites from there.

Crystal will go over the rules with you before you start. Remember to bring gloves, a garbage picker upper (if you have one), hat, water etc. Safety vests will be provided. No children under 12 allowed. (State rules…sorry) wear good shoes, no sandals or shorts.*NOTE: It is snake season and likely that we may encounter one on the highway. Please be sure to wear long pants and boots/hiking shoes if possible!

The clean up normally takes about 1- 1 1/2 hours depending on the number of people who show up to volunteer.

It’s hard to imagine that day was 29 years ago, sometimes I feel it like it is now.

As another year passes, I would like to take today to honor the anniversary of Vicki Lynne’s death with stories and memories, whether you knew her or if her life impacted yours, I invite you to share. How Vicki died is not the most important part, it was just the beginning of many things. How Vicki continues to live in our hearts and how she touches our souls is so much more.

I see her in the faces of my two girls everyday, especially in my youngest daughter, Mackenzie. She has her Aunt Vicki’s blue eyes, her freckled face, her gapped tooth smile, and witty personality.  Boy, can she entertain you… just like Vicki used to… Mackenzie also has her love for softball. Last Wednesday night they got their team shirts for fall league, Mackenzie is sporting a pink #8 … Vicki’s favorite color and the age she was when she left us. And, although Madison favors me in her appearance, she has many mannerisms that remind me of Vicki, the way her eyes look at you, how she giggles and how gentle her soul is.  These are daily gifts that bless my life.

And, I have many memories to share … but if I were to share one of our favorite things to do, it comes from a picture that caught us nose to nose sitting in the back of our boat at Apache Lake (AZ) with our father skiing behind us.  We loved going to the lake, swimming, playing, water skiing but laying underneath the night sky counting the stars above tops my favorites. I still find myself staring off into the sky at night and waiting for a shooting star, which I know are her gifts to me.

Racing, A story of how we met & how it’s still a major part of our life…

People have asked me lately, “What does your husband do?”  “How did you meet him?”  “He does WHAT for a living?” “You like NASCAR racing?”

Yes, I like racing and here’s a little bit more about how it plays a role…

Stock car racing has always been a part of my life. It started as a family affair with my “Papas”, a.k.a. Carl Trimmer, my dad, uncles, and brother, it continued when I met Scott. (www.trimmermotorsports.com)

We met in the winter of 1996-1997 during the ESPN2 Winter Heat Late Model Racing Series held at Tucson Raceway Park. After the last race, Scott & I were walking across the infield together back to the “pits”. Scott was the Crew Chief for Marc Groskreutz, who had just finished 2nd behind my “Papas” in the Championship.  As we chatted walking across the track that day, I never thought I would see him again. Little did I know, Scott was later offered a Super Late Model Stock Car “ride” by Patrick’s Motorsport’s and he moved to Tucson the following spring of 1997.

Mutual friends encouraged me to call him, he only knew a few people in Tucson and they thought we would hit it off. After a bit of coaxing, I called and we met up at Hooters for wings and beers… I add this because truly, I never thought it would go anywhere, and anyone serious wouldn’t really go on their first date to Hooters! Would they???

The rest is history, we married in April of 2001. Scott raced Super Late Models & the NASCAR Southwest Tour Series in those years. When we had Madison in June of 2002, we traveled with a Late Model Stock Car to race in Montana’s biggest race of the year, The Montana 200, held at Montana Raceway Park. It had been our third trip up to race in the big event, and Scott came close to winning that year until an electrical fire took us out in the end. It was a long tough trip and in the end we both knew Montana was calling us home.  It was a difficult decision for Scott to leave behind a racing career, and for me to leave my family in Tucson.

In the years since, Scott has crawled behind the wheel of a Late Model Race car, a handful of times, leaving the drivers seat with a win under his belt in the Canadian-American Shoot-Out at Montana Raceway Park in 2004.

He spent almost 6 years as the Crew Chief for local race car driver, Mark Owens. In their years together, they had 1 Championship, 2 handfuls of wins and numerous fast times.

Racing continues to play a major role in our life, and how lucky Scott is to be able to make a career doing something he is so passionate about.

Scott is currently working with Giles Thornton, an up and coming NASCAR racer who calls Whitefish, MT his home. When we met Giles a few years ago, Scott saw something in him that not a lot of others did and he built him his first Late Model Stock Car.

In the last year, a team has formed behind Giles that I am proud Scott is part of. The Crew Chief, Travis Sharpe, brought his family from the east coast and has helped Giles grow in amazing ways. Travis is incredibly talented, and a strong team leader. Ted, a long time Tucson friend, moved his family to Kalispell this winter and is the team’s Truck Driver & “Do whatever else needs to be done guy!”. He brings many years of racing experience with him, and we are lucky to have him! Roy, a Yakima native, joined the team a few months ago and has a lot of NASCAR K&N Series experience which brings a lot to the team. Scott is the Car Chief, and his primary responsibilities are the engine & shock program, and assist Travis in the car chief departments. All of these men work well together, and I am constantly impressed with what they are accomplishing

Giles Thornton is racing a full schedule of the NASCAR K & N Series, and selected Late Model Shows in Montana, Idaho & Washington.

I know there will be some good racing in the months ahead, and that Giles will be one to watch! Scott was talking with Madison, our oldest daughter, Saturday night as we were watching the NASCAR All Star Shoot Out on T.V. He told her that one day we will be watching Giles in that race, and there is no doubt in my mind that we will!

Over The Rainbow Memorials

Almost five years ago, an amazing and beautiful friend named Krista entered my world. We have shared a lot in our short journey together, and I feel so blessed to have her in my life. Aside from being one of my very best friends, she is an amazing artist. I was immediately drawn to her work, and knew that being brought together was not a conciendence.

Krista, through her company Over The Rainbow Memorials, makes handcrafted glass memorials to help us honor and remember our loved ones.

I went to Krista and asked her to make me a pendant in memory of Vicki. Typically, she takes ash or hair from your loved one and uses it to create a memorial. I had neither to offer… just two trunks of Vicki’s personal things that mom had kept through the years. When we discussed what was in the trunks, I mentioned that I had the outfit that Vicki came home from the hospital in and her “Brownie” uniform.

Krista immediately had the idea to take snippets of her clothing, two things with so much meaning, and use them to create my memorial.

She made me a pendant with seas of blue that can take me right into Vicki’s eyes. Sparkles of pink, her favorite color, as the snippets of fabric run through the glass. Just holding the pendant in my hands fill my heart with an amazing amount of joy and comfort.

We have asked Krista again to make a few more pieces for loved ones, and when she finished this heart pendant for my sister, Carie, I was amazed again. She not only captured the blues of Vicki’s eyes, but colors that fit Carie’s style so well. I am anxious to see the rest of the memorials as she finishes them.

Krista continues to amaze me with the compassion and love she puts into the memorials she makes for us to remember our loved ones by. It is a gift and talent that is treasured.

Wondering about Frankie’s Return Policy?

Many times in the recent weeks I have questioned my sanity, and wondered what we were thinking when we allowed “Frankie” to bring us TWO kittens for Christmas. I  have even joked with Madison and Mackenzie about returning Samuel & Snow Socks to the North Pole, don’t Santa’s elves have a return policy?

The christmas tree made it through the holidays without being tipped over, however, I must disclose it would have taken a big force to knock it out of the heavy metal stand it was placed in. Many of the ornaments were knocked off the tree as Samuel found himself climbing to the top on numerous occasions.

Snow Socks & Samuel “chatter”, it’s funny to hear their voices, which is different than their purring. I think they are talking back to me sometimes when I am telling them to get off the table or getting them out of the plants.

I am surprised out how much these two little kittens eat… I think Flomar, our 65 pound Labrador, may actually eat less.  We won’t even discuss the litter box. I seriously need to watch Meet the Parents to see how Robert De Niro trained his kitty, Mr. Jinx, to go in the potty and flush the toilet!

Speaking of flushing, Snow Socks is fascinated by the toilet and we are having to enforce a strict lid down policy in the house! Not to mention, we can’t put the toilet paper on the roll in the downstairs bathroom as they unravel it any chance they get.

And the chewing! They chew EVERYTHING! We must have been lucky when we got Flomar, he was never destructive when it came to things in the house, nor does he get in the trash. He will destroy a newly purchased dog bed or “undesctructable” dog toy in no time, but he has always left our personal items alone. Samuel and Snow Socks are a completely different story!

They can fling dirt out of a potted plant further than an NFL kicker punting a field goal and there isn’t a safe spot in the house. They climb and jump in places I never imagined they would.

And, they are FAST. They race around the house as if it is the final laps of the Daytona 500… 2 wide, side by side! Just a warning, if you happen to stop by during “race time” you are considered a moving target and may find a cat clinging from your pants or shirt!

Here they sleep so quiet and peaceful, and I can’t help but think that Snow Sock’s black tipped nose is just kissable and how sweet it is that they are so snuggly?

All joking aside, I couldn’t imagine our lives without them. There is not much that happens in the house that Samuel, Snow Socks & Flomar aren’t right at our feet. The girls play with them for hours and it is amusing to listen to the conversations they have with our four legged friends. They are a lot of company, and when they snuggle up to sleep by us it brings us all a lot of joy and comfort. And there is nothing about that that I would ever want to change.

 

 

 

“Hound Hog’s Day”

Ground Hog’s Day, jokingly known as “Hound Hog Day”, is also my sister, Vicki’s birthday.

This week at school our girl’s learned about Punxsutawney Phil and what it means if he will see his shadow or not.  As we discussed the meaning of today, I shared with the girls that Ground Hog’s Day is also Aunt Vicki’s birthday. And how when she was small she couldn’t say her “G’s” very well so she would call it “Hound Hog’s Day”.

Madison & Mackenzie often ask me questions about Vicki. “Mom, Did Aunt Vicki like horses?” “Do you think she would like to ski?” “What was her favorite color?” “Did she draw well?”“Did she play with dolls?” “Could she run fast?”

These questions happen randomly and sometimes catch me off-guard. It makes me happy they are curious to know more about her, but it also has made me realize that sometimes we may talk more about what happened to Vicki than about her life.

Vicki’s favorite color was pink and she loved Strawberry Shortcake.

She was a fierce competitor and would “scrap with the best of them” if you ask our elementary p.e. teacher, Coach Hall.

Vicki had a fire in her eyes that let you know she was serious, and a smile to go with her amazing blue eyes that would melt your heart.

She would light up a room when she walked in and entertained you.

Vicki did not liked to be teased about her freckles… aka… angel kisses.

Her nickname was “Oooggle Boogle”.

She wanted to learn to twirl a baton.

Vicki was proud of her younger brother, and giggled when we dressed him up in girls clothes and strolled him around the block..

She was proud to be a “Girl Scout Brownie”… we still have her uniform.

Vicki spent many Saturday nights cheering her Papas on at the race track, she was proud of him!

She loved tacos, but hated pizza.

Vicki was “Annie’s” double.

She loved her pink bike.

Vicki was a softball playing machine. And, she meant business on the field. This must have been a natural family talent.

She loved playing barbies and having sleepovers.

We loved it when our Aunt Kimmy made us spaghetto’s and french fries.

And, although I have many memories, one of my favorites is the times we spent out underneath the starry skies at the lake.

Today I hope that if you didn’t know her before she passed away, that you know a little more about her now.

Her life was short, but it was packed full of LIFE. And, I never want to lose sight of that or stop sharing our stories and memories of her.

Happy 37th Birthday Vicki… We love and miss you!

That’s the number of unanswered e-mails in my in-box tonight. From the “Death Penalty” post on September 12th to today, that is how many messages I have not had a chance to respond to.

The number of emails, Facebook messages, posts, text messages and phone calls I have answered is easily been double that. I said today to a fellow co-worker that I might be “slow but sure” she said she would just call me a “turtle”. I liked that. Specifically because in my own chaotic world, I may not get to do things as fast and efficient as I would like to but I do get to “it”.

During the last two weeks, I have found it difficult at times to find the right words to express how I truly feel. Honestly, when I sat down to the computer late in the evening on September 17th and looked at my in-box & Facebook the only thing I could think to say was “My cup runneth over…”

Sentimental… overwhelmed… loved… supported… encouraged…

Yes, that’s me.

           I’m not going to comment any further on this ridiculous event they tried to put on. 

           We are back in a holding pattern for the appeal’s process. All any of us can do is pray and wait.  I will keep you updated here.

           On the 28th anniversary of Vicki’s death, I shared my cousin, Michelle’s, blog. I feel as though it opened up a flood gate for people. I loved the thoughtfulness of the day, the stories, pictures and memories that people shared. I also deeply appreciated the fact that people could reflect back on a pivotal event almost 30 years ago and know that it continues to shape them.  

A few years ago someone said to a mutual friend of mine that they did not understand why I would want to write a book about my sister. Why can I not just let it go? As if I could just brush this under the rug and pretend it didn’t happen to me?

I have lived longer with the memory of Vicki than I lived with her. The emails, calls and texts I have gotten in the last two weeks prove that I’m not the only one who carries on her legacy, who will never forget Vicki Lynne and that terrible day that so many lives changed.

And I know if it had been me, she would honor my life just the same.
